Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymised string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognise and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Terms & Conditions

It is the responsibility of the customer to read through the General Conditions before placing orders. Once an order has been placed, this means that the customer has accepted these conditions.

  1. Goods must be paid in full and funds must reflect in our bank account before they are dispatched.
  2. Products offered are subject to availability and price may change without notice. If payment is made and the product is unavailable we will offer a substitute for you to consider else a refund on that product will be given.
  3. All products are genuine articles and have a guarantee against factory fault, but will not be replaced through failure due to fair wear and tear.  Faulty goods must be reported within 30 days of receipt.
  4. On dispatch customer will be notified and given a tracking/reference number.  Any goods not collected from the delivery address will be returned to the supplier.  An additional postage charge will apply to resend the goods.
  5. A cancellation fee of 10% will apply on any order to cover bank and admin costs if the order has been processed through our system.
  6. Any customisation or printing of goods is done at the risk of the customer and should be signed off by the customer before commencement / manufacturing.
  7. Allow 7-10 days delivery from date of despatch with the Post Office.  Allow 2-5 days delivery with the courier from date of despatch.
  8. We regret we do not accept cheques.

GENERAL ENQUIRIES

Please allow 24 hours for our support team to respond to queries. Please note that operating hours are 8am-5pm, Monday to Friday.

GUARANTEE AND RETURNS

If you are unhappy with the goods you have received due to damaged material or factory faults you can return them to us for a replacement or a full refund of the purchase price. Products must be returned to us within 10 days of receipt and at the customers expense. Refunds for the purchase price (which does not include postage) will be issued for products returned in perfect condition and in their original packaging. We cannot refund clothing or accessories which have been printed or customised specifically to your needs according to your sizes or colours. Please note that the returned goods are your responsibility until they reach us. We cannot be held responsible for any goods lost in transit to us. All our products are Official Products straight from the licensed manufacturers and will not accept returns regarding this matter. If we are unable to supply an item and payment has already been made, you will have two options: 1) We will issue you a full refund of the purchase price less a 10% admin fee, or 2) You can choose to wait until the item is in stock again.

Pictures on the site may at times vary in detail and colour to the actual product. Custom Kits: all our custom kits are manufactured with the highest of quality. Sizes and colours may vary so it is the responsibility of the customer to purchase a sample before ordering a set of kits. The reason for this is because there are thousands of various shades of blues and greens etc., so what you see on screen will be as close as possible to the actual colour of the kits. Once the kits have been personalised with names or numbers etc. it will not be returnable as we may not be able to resell your custom kits. It is the customers responsibility to read through the conditions on our website before purchasing. SportsApp will pay the postage price for any goods that need to be resent in an exchange situation where a fault was made on our side.

HOW TO ORDER AND PAY

On the site: Use our online store for the fastest, most secure way of ordering sportswear and equipment

Bank Transfer: You can pay for your order to the SportsApp Bank account from South Africa. Once you place your order, we will send you an official invoice with banking details on. Once you’ve transferred the total invoice amount into the SportsApp account, we will then ship your order to you. We however do not accept any cheques under any circumstances. Bank Transfer and commission fees belong to the buyer.

Internet bank Transfer: We accept payments via the internet (bank to bank). Once you place your order, we will send you an official invoice. Once you’ve transferred the total invoice amount into the SportsApp account, we will then ship your order to you.

All payments made off the website should be accompanied by a reference number which will be the word “online” followed by your order number. E.g. “onlineXNXQQDBQD” This way we are able to trace the source of each payment. Please use your reference number when paying. If you are not provided with an order number, simply email us and we will provide you with one.

Once your payment is accepted, you will receive an email confirming the items that you have ordered. This will serve as your invoice. We will then process the order and inform you when the order is shipped to you.

Order acceptance and the completion of the contract between you and us will take place on the dispatch of the Products ordered to you unless we have notified you that we do not accept your order or you have cancelled it in accordance with the instructions in ‘Guarantee and returns’.

Non-acceptance of an order may be a result of one of the following:

The product you ordered being unavailable from stock.

  1. Our inability to obtain authorisation for your payment.
  2. The identification of a pricing or product description error.
  3. You not meeting the eligibility to order criteria set out in the main Terms and Conditions.

In order to combat fraud, we have setup a verification system which may require customers with orders over a certain value, to confirm certain information with us either via telephone or email. Failure to provide us with these details may force us to cancel your order and refund your card according to our terms and conditions. Please keep in mind that these checks are done purely for the security of our customers.

Damages:

Any damaged goods should be returned to us for replacement. Incorrect/faulty goods must be returned to us before replacements are sent out. In this situation SportsApp will accept all postage charges.

PROCESSING OF ORDERS

All prices include sales taxes (where applicable) unless otherwise stated. SportsApp aims to arrange shipment of all “IN STOCK” items within 48 hours of receiving your order.  If your items are not in stock the order will take 8-15 working days for the stock to be shipped from the overseas manufacturers to our distribution. Your order may be delayed if the item is not in stock with our suppliers. Some items may be unavailable and the current stock status is approximate. SportsApp at times may not be able to supply by the estimated dates until our suppliers get the items in stock. If you have opted for a kit being numbered or printed on at all, please add an additional 3-5working days to the above.

DELIVERY

Shipping/Postage of “IN STOCK” goods will take place within 24-48 hours of received payment confirmation. Goods will be posted Counter to Counter unless stated otherwise and a tracking number will be provided for the customer to collect at the nearest post office…this will take approximately 24- 48hours (from dispatch time from our distribution) to arrive if the “SPEED SERVICES” option was selected with your payment.

If your selected items are not “IN STOCK”, please allow 8-15 working days. If our suppliers are out of stock, SportsApp will give you a full refund of the purchase price

Confirmation of payment refers to the amount reflected in the bank account of SportApp , and not the one you may have with you. Customers must use the word “online” followed by your order number, E.g. “online12345,” as a reference when paying.

The period stated within which you will receive your order is approximate. Goods will be sent to your nearest post office of the address given by you in your order and stated in the Order Confirmation. Please note that your goods may be sent to you in instalments. Title to any product ordered will pass to you once SportsApp has received payment in full for that product. Risk in any product ordered will pass upon delivery to you.

ORDER CANCELLATIONS

Please note that payments on orders booked for EFT/bank transfer need to be paid within 72 hours. If no payment has been made within this period, your order will be cancelled and released back into stock for others to purchase.

This Website may contain links or references to other websites (“Third Party Websites“) outside of our control, including those of advertisers. These Terms and Conditions do not apply to those Third Party Websites and SportsApp is not responsible for the practices and/or privacy policies of those Third Party Websites or the cookies that those sites may use.

Notwithstanding the fact that this website may refer to or provide links to third party websites, your use of such Third Party Websites is entirely at your own risk and we are not responsible for any loss, expense, claim or damage, whether direct, indirect or consequential, arising from your use of such Third Party Websites or your reliance on any information contained thereon.

If you disclose your personal information to a third party, such as an entity which operates a website linked to this Website or anyone other than SportsApp, SPORTSAPP SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE, HOWSOEVER ARISING, SUFFERED BY YOU AS A RESULT OF THE DISCLOSURE OF SUCH INFORMATION TO THE THIRD PARTY. This is because we do not regulate or control how that third party uses your personal information. You should always ensure that you read the privacy policy of any third party.

LIMITATION OF LIABILITY

SPORTSAPP SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL INJURY, LOSS OR DAMAGES WHICH MIGHT ARISE FROM YOUR USE OF, OR RELIANCE UPON, ANY MATERIAL OR CONTENT CONTAINED IN, OR INABILITY TO USE, AND/OR UNLAWFUL ACTIVITY ON, THE WEBSITE AND/OR ANY LINKED THIRD PARTY WEBSITE.

YOU HEREBY INDEMNIFY SPORTSAPP AGAINST ANY LOSS, CLAIM OR DAMAGE WHICH MAY BE SUFFERED BY YOURSELF OR ANY THIRD PARTY ARISING IN ANY WAY FROM YOUR USE OF THIS WEBSITE AND/OR ANY LINKED THIRD PARTY WEBSITE.

IMPORTANT GARMENT CARE:

  1. Do not wash over 40°C

Do not wash any garment at a temperature over 40°C.  Washing powders & liquid detergents are designed to work in low energy 30°/40°C washes, as they dissolve quickly & contain special ingredients to aid stain removal.

IF YOU WASH YOUR GARMENT OVER 40°C YOU WILL ENCOUNTER PROBLEMS, FOR WHICH WE CANNOT BE HELD RESPONSIBLE.

  1. Do not tumble dry
  2. Do not bleach

Do not use bleach or any product/additive that includes chlorine, peroxide or perorate.

  1. Do not iron on print

Turn garment inside out before ironing to avoid print from smudging.

Any damage to the garments by any customer who does not adhere to the above will not be refunded. SportsApp will not be held responsible unless the above was taken into consideration when washing.

CHANGES TO THESE TERMS AND CONDITIONS

SportsApp reserves the right to update and/or amend the Terms and Conditions from time to time and without any notice, and you are accordingly encouraged to check the Website regularly. Any such change will only apply to your use of this Website after the change is displayed on this Website. If you use this Website after such updated or amended Terms and Conditions have been displayed on this Website, you will be deemed to have accepted such updates or amendments.

Availability and termination

  1. We will use reasonable endeavours to maintain the availability of the Website, except during scheduled maintenance periods, and reserve the right to discontinue providing the Website or any part thereof with or without notice to you.
  2. SportsApp may in its sole discretion terminate, suspend and modify this Website, with or without notice to you. You agree that SportsApp  will not be liable to you in the event that it chooses to suspend, modify or terminate this Website.

Governing Law
These Terms and Conditions shall be governed and interpreted in accordance with the laws of the Republic of South Africa. Your continued use of the Website will constitute your consent and submission to the jurisdiction of the South African courts regarding all proceedings, transactions, applications or the like instituted by either party against the other, arising from any of these Terms and Conditions.

When you place an order with SportsApp you will receive various emails notifying you of your order status, please see below status jargon used:

  • Pending – Order received (unpaid)
  • Failed – Payment failed or was declined (unpaid)
  • Processing – Payment received and stock has been processed – order awaiting fulfillment
  • Completed – Order fulfilled and complete – requires no further action
  • On-Hold – Awaiting payment
  • Cancelled – Cancelled by an admin or the customer
  • Refunded – Refunded by an admin
